1. Acceptance of Terms
By accessing the website at https://dev-tempopoint.click or entering into a consulting engagement agreement with Dev Tempopoint (operating under principal consultant Zhihao Chen, No.28, Sec 5, Zhonghua Rd, Sanchong District, New Taipei City, 241, Taiwan), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must discontinue use of our site and services.
2. Nature and Scope of Consulting Services
Dev Tempopoint provides specialized software programming consulting, release readiness auditing, deployment choreography runbook authoring, and cutover governance advisory. All consulting services are provided on an advisory and diagnostic basis:
- Dev Tempopoint consultants deliver analysis, blueprints, runbooks, and recommendations based on information, architecture diagrams, and pipeline definitions provided by the client.
- Unless expressly agreed upon in a signed master services agreement, Dev Tempopoint consultants do not maintain direct root write access or operational execution custody of client production cloud clusters.
- Final deployment decisions, production code merges, and execution of live cutover commands remain under the ultimate custody and operational authority of the client's designated personnel.
3. Intellectual Property Rights
All materials published on this website, including technical guides, articles, illustrations, logos, and custom layout frameworks, are the intellectual property of Dev Tempopoint and protected under Taiwan copyright laws and international intellectual property conventions.
Upon full settlement of agreed engagement invoices, clients receive a perpetual, non-exclusive, irrevocable internal license to use, adapt, and execute all custom-authored cutover runbooks, branching policy documents, and rollback scripts created specifically for their engagement.
4. Client Responsibilities and Prerequisites
To enable timely and accurate consulting deliverables, the client agrees to:
- Provide accurate and complete architectural documentation, CI/CD pipeline manifests, and environment specifications relevant to the agreed scope.
- Designate a qualified engineering representative (Release Lead, Technical Architect, or Director) to participate in scheduled discovery sessions and gate review meetings.
- Maintain independent, verified backup archives of all source code repositories, databases, and configuration stores prior to conducting pre-production rehearsals or live cutovers.
5. Limitation of Liability
To the maximum extent permitted by the laws of Taiwan, Dev Tempopoint and its consultants shall not be liable for any indirect, incidental, consequential, punitive, or special damages, including loss of profits, data corruption, business interruption, or system downtime resulting from the implementation or non-implementation of advisory recommendations. Dev Tempopoint's cumulative liability for any direct claim arising from a consulting engagement shall be strictly limited to the total consulting fees paid by the client under the specific Statement of Work giving rise to the claim.
6. Confidentiality and Non-Disclosure
Both parties agree to treat all non-public technical information, architecture diagrams, source code repositories, pipeline definitions, and business discussions as strictly confidential. Dev Tempopoint will not disclose or publish any client-specific identifying operational data or architecture vulnerabilities without prior written authorization.
7. Governing Law and Dispute Resolution
These Terms of Service and any consulting contracts formed hereunder shall be governed by and construed in accordance with the laws of Taiwan (Republic of China). Any dispute, controversy, or claim arising out of or relating to these terms or our consulting services shall be submitted to the exclusive jurisdiction of the New Taipei District Court or Taipei District Court in Taiwan as the court of first instance.
8. Modifications to Terms
Dev Tempopoint reserves the right to revise these terms at any time by updating this page. Continued engagement with our services following the posting of modifications constitutes acceptance of the updated terms.
